MINUTES of a regular meeting of COMMITTEE OF THE WHOLE of the Municipal Council of The Corporation of the District of Oak Bay, held in the Council Chambers, Oak Bay Municipal Hall, 2167 Oak Bay Avenue, Oak Bay, B.C., on Tuesday, September 4, 2007 following the Special Meeting at 7:30 p.m.

Acting Mayor Carson called the meeting to order at 7:36 p.m.

 

Prior to attending to the regular items of business, and in response to a request from the Chair, the Municipal Administrator provided a brief update on the tragic incident that occurred at a home on King George Terrace early in the morning.

DIRECTOR OF BUILDING AND PLANNING, August 27, 2007

Re Development Variance Permit Application – 2861 Eastdowne Road

 

It was noted that the applicant had submitted revised plans for a garage, incorporating recommendations from the Advisory Design Panel.

 

Ted Pobran, 2861 Eastdowne Road, advised that the new plans for the garage show a single car garage versus the two car garage that was first proposed, and that the garage is now proposed to be situated further back from the front lot line.

 

There was discussion regarding the revised plans, and Mr. Pobran confirmed that while the computer generated rendering gives a good idea of the scale and how the garage will blend into the streetscape, it does not quite reflect the new design precisely.

 

It was noted that usually more detailed plans are provided by applicants, with those plans then being distributed to neighbouring properties, should the application proceed to the notification stage.  Members of the Committee suggested that further detail would be useful prior to proceeding to Council.

 

Mr. Pobran agreed to supply plans with additional detail for consideration by Committee of the Whole.

Seconded by Councillor Herbert, That correspondence item no. 2007-232 be deferred pending receipt of detailed plans.

DIRECTOR OF BUILDING AND PLANNING, August 29, 2007

Re Development Variance Permit Application – 1745 St. Ann Street

 

Warwick Newman, 1745 St. Ann Street, provided an overview of his proposed plans to construct an in ground pool and patio area. 

 

Responding to questions from the Committee, the Director of Building and Planning confirmed that both the pool and the surrounding patio area are considered accessory structures under the Zoning Bylaw, therefore a variance would be required to permit the requested lot coverage for accessory structures.

 

Mr. Newman responded to questions from the Committee with respect to the landscaping plans he has for around the pool, noting that a retaining wall would be required on the east property line, being low on the north end and increasing in height towards the south due to the slope of the lot.  He also drew attention to the proposed fencing and plantings.

 

Responding to a question from a member of the Committee, Mr. Newman confirmed that the existing large Willow tree would be preserved.

Seconded by Councillor Braithwaite, That a resolution authorizing the issuance of a development variance permit for 1745 St. Ann Street be prepared and brought forward to Council for formal consideration.

Re Development Variance Permit Application – 843 Newport Avenue

 

Responding to questions from the Committee, the Director of Building and Planning noted that the applicants wish to construct a roof over a gazebo.  The overhang of the roof of the house, said Mr. Beattie, would meet with the overhang from the roof of the gazebo, therefore a variance with respect to the required clear space between buildings and structures would be needed.

Seconded by Councillor Braithwaite, That a resolution authorizing the issuance of a development variance permit for 843 Newport Avenue be prepared and brought forward to Council for formal consideration.
