DIRECTOR OF BUILDING AND PLANNING, February 28, 2008

Re Development Variance Permit Application – 1852 Hampshire Road

The Director of Building and Planning explained that although a variance has already been approved for the rose arbour at 1852 Hampshire Road, it was based upon erroneous information.  He advised that it was believed that the arbour was built approximately two feet from the side lot line when, in fact, following receipt of a land survey, it was determined that it was built on the property line.  Therefore, he said, a further variance is being sought by the owners in this regard.

MOVED by Councillor Herbert

Seconded by Councillor Copley, That it be recommended to Council that a resolution authorizing the Director of Building and Planning to issue a development variance permit for 1852 Hampshire Road, as outlined in correspondence item no. 2008-63, be prepared and brought forward to the next meeting of Council for consideration.

Re Boulevard Encroachment Application – 825 Linkleas Avenue

Attention was drawn to the staff recommendation to deny the boulevard encroachment application as outlined in correspondence item 2008-64.

Responding to questions, the Director of Engineering Services noted that the proposal was elaborate, taking over an extensive amount of public property.  He further pointed out that a storm drain would lie under the proposed encroachment, which would create issues regarding access, should it be required.

MOVED by Councillor Jensen

Seconded by Councillor Cassidy, That it be recommended to Council that permission for an encroachment onto the boulevard adjacent to 825 Linkleas Avenue be denied.

Members of the Committee agreed that the proposal would take a significant amount of public property into private use.

The question was then called.
